These Terms and Conditions apply when you use the Arcade Classics website, purchase products from us or request repair, servicing or related services.

By placing an order, accepting a quote or asking us to begin approved work, you agree to these terms. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

01

Business Details

Arcade Classics is operated by ARCADE CLASSICS AUSTRALIA PTY LTD, ABN 49 687 644 739.

In these terms, “Arcade Classics”, “we”, “us” and “our” refer to the business operating the Arcade Classics website and supplying the relevant products or services.

Our contact details appear at the end of these terms.

02

Website Use

You may use this website for lawful personal or business purposes, including viewing products, placing orders and submitting enquiries.

You must not:

  • use the website unlawfully, fraudulently or deceptively;
  • attempt to interfere with the operation or security of the website;
  • introduce malicious code, automated scraping tools or harmful material;
  • use our content or branding in a way that suggests our endorsement without permission; or
  • submit false, misleading or unauthorised information.

We may temporarily restrict access to the website for maintenance, security, technical problems or other legitimate operational reasons.

03

Product Information

We take reasonable care to ensure product descriptions, photographs, availability information and prices are accurate. Minor differences may occur because of screen settings, lighting, manufacturing variations or updates to products.

Arcade and pinball equipment may be new, used, restored, refurbished or sold in its existing condition. The applicable product listing, quote or invoice will identify the known condition where relevant.

Older and second-hand machines may show cosmetic wear, repairs, replacement components or other characteristics consistent with their age, previous use and condition.

We will disclose known material defects that affect the product where reasonably practicable. A disclosed defect that you specifically accept before purchase may affect the remedies available for that particular defect, but it does not remove any other rights available under applicable law.

04

Prices, Orders and Payment

Prices

Unless stated otherwise, prices are displayed in Australian dollars and include GST where GST is applicable. Delivery, installation, access, specialist handling or other additional charges will be shown or agreed before payment where they apply.

Placing an order

Submitting an order is an offer to purchase the selected products. An automated email acknowledging receipt of an order does not necessarily mean that the order has been accepted.

An order is accepted when we confirm acceptance, begin preparing the goods for supply or otherwise communicate that the order has been approved.

Payment

Payment must be made using one of the methods offered at checkout or otherwise agreed with us. We may carry out reasonable payment, identity or fraud checks before accepting an order.

Pricing or listing errors

If a genuine pricing, availability or description error is identified before an order is accepted, we will contact you and provide the option to proceed using the corrected information or cancel the affected order for a refund.

Availability

Product availability can change, particularly for unique, vintage, second-hand or limited-stock items. If we cannot supply a paid order, we will contact you and provide an appropriate solution, which may include an agreed alternative, replacement or refund.

Deposits and special orders

Any deposit, special-order, custom-order or cancellation conditions will be disclosed before the relevant payment is made. Those conditions do not exclude rights that cannot lawfully be excluded.

05

Delivery and Collection

Delivery information

Delivery charges, methods and estimated timeframes depend on the product, destination, access requirements and selected delivery provider.

Delivery dates are estimates unless we expressly agree to a fixed date. We will take reasonable steps to supply products within the agreed timeframe or, where no timeframe is agreed, within a reasonable time.

Customer information and access

You are responsible for providing:

  • an accurate delivery address and contact details;
  • relevant information about stairs, lifts, narrow access points or other restrictions;
  • a safe and reasonably accessible delivery location; and
  • an authorised person to receive the delivery where required.

If information about access was incomplete or inaccurate, we will discuss any necessary change to delivery arrangements or additional reasonable cost before performing additional work.

Inspection on delivery

Where reasonably possible, inspect the packaging and product when it arrives. Please notify us promptly of visible transport damage, missing items or an incorrect delivery so that we can investigate. A delay in reporting does not automatically remove rights available under applicable law.

Collection

Collection must be arranged in advance. We may request proof of purchase or identification before releasing an order.

Customers arranging their own transport are responsible for safely securing and transporting the product after collection. This does not affect responsibility for faults or damage that existed before collection.

06

Arcade and Pinball Machine Condition

Arcade and pinball machines may contain mechanical, electrical, electronic and cosmetic components of different ages. A restored or serviced machine may still contain original or previously replaced components.

Unless expressly stated otherwise, restoration or servicing does not mean that every component is new or that a vintage machine will be cosmetically identical to a newly manufactured product.

Product condition, age, price, disclosed faults and intended use are relevant when assessing what can reasonably be expected from a second-hand or vintage machine.

You should follow any operating, transport, storage, voltage, ventilation and maintenance instructions supplied with the machine.

07

Repairs and Servicing

Repair enquiries

A repair enquiry is a request for us to assess whether we may be able to assist. Submitting an enquiry does not guarantee that we can accept or successfully complete the repair.

Assessment and diagnosis

Some faults require diagnostic work before the cause, repair method, parts requirements or likely cost can be identified.

Any assessment, inspection or diagnostic charge will be disclosed and agreed before chargeable diagnostic work begins.

Quotes and approval

Where practical, we will provide an estimate or quote after the initial assessment. A quote may be subject to further faults, concealed damage or parts requirements that could not reasonably be identified during the initial assessment.

We will seek your approval before carrying out a material variation to the agreed work or cost.

Replacement components

Depending on age and availability, replacement components may be new, refurbished, reconditioned or suitable used parts. We will disclose the proposed type of replacement where it is material to the repair.

Older and previously repaired equipment

During reasonable diagnosis or testing, aged, deteriorated or previously damaged components may reveal additional faults. We will advise you if this occurs.

This clause does not exclude responsibility where damage is caused by our failure to provide services with due care and skill.

Repairability

Some products may not be economically or technically repairable because of extensive damage, unavailable components, previous modifications, corrosion or intermittent faults that cannot be reliably reproduced.

If we cannot complete an approved repair, we will explain the outcome and any charges properly incurred for agreed assessment or work already performed.

Authority to request work

By leaving equipment with us, you confirm that you own the equipment or have authority from the owner to approve assessment and repair work.

Collection after repair

We will contact you when equipment is ready for collection or return. Equipment should be collected within the agreed or notified period.

Any storage arrangements or reasonable storage charges will be communicated before they apply. Uncollected equipment will only be dealt with in accordance with applicable law and after appropriate notice.

08

Returns, Refunds and Consumer Guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.

Depending on the circumstances, available remedies may include a repair, replacement, refund, resupply of services or compensation for reasonably foreseeable loss.

The appropriate remedy depends on matters including the nature and seriousness of the problem, whether it can be remedied within a reasonable time and the applicable consumer guarantee.

We do not apply a blanket “no refunds” rule where a customer has a legal right to a remedy.

Change-of-mind requests, where no fault or legal right to a remedy exists, are handled in accordance with our Refund and Returns Policy.

We may ask for reasonable proof of purchase when assessing a request for a repair, replacement or refund.

09

Warranties

Any voluntary, manufacturer or repair warranty offered by Arcade Classics is additional to rights available under the Australian Consumer Law.

The expiry of a voluntary or manufacturer warranty does not automatically determine whether consumer guarantee rights continue to apply.

Specific voluntary warranty terms, exclusions and periods will be provided with the relevant product, quote or invoice where applicable.

A voluntary warranty may not cover faults caused by misuse, accidental damage, incorrect installation, inappropriate voltage, unauthorised modifications, improper transport, neglect or failure to follow supplied instructions. This does not exclude liability for a defect or failure for which we are legally responsible.

10

Customer Responsibilities and Liability

You are responsible for:

  • providing accurate information relevant to an order, delivery or repair;
  • using products safely and for their intended purpose;
  • following supplied installation, operating and maintenance instructions;
  • ensuring appropriate power, ventilation and environmental conditions; and
  • notifying us promptly if a product or repaired item develops a problem.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded.

To the extent permitted by law, we are not responsible for loss or damage caused to the extent it results from:

  • misuse, neglect or accidental damage after supply;
  • incorrect installation, voltage or operating conditions not provided by us;
  • unauthorised repairs, modifications or third-party work;
  • inaccurate or incomplete information supplied by the customer;
  • ordinary wear consistent with a product’s age, condition and use; or
  • an event outside our reasonable control, except where we remain responsible under applicable law.

11

Privacy and Personal Information

We may collect personal information needed to process orders, provide products and services, respond to enquiries, manage deliveries, prevent fraud and meet legal obligations.

Personal information is handled in accordance with our Privacy Policy and applicable privacy laws.

When submitting photographs, video or other files, you must ensure that you have authority to provide that material and that it does not unlawfully disclose another person’s private information.

12

Intellectual Property

Unless stated otherwise, the website design, text, graphics, photographs, logos, product presentation and other original content are owned by or licensed to Arcade Classics.

You may view and use the website for ordinary personal or business purchasing purposes. You must not reproduce, republish, sell or commercially exploit our original content without permission, except where permitted by law.

Product and manufacturer names, artwork and trademarks may belong to their respective owners.

13

Third-Party Services and Links

The website may use or link to third-party payment, delivery, hosting, mapping or other service providers.

Those providers may have their own terms and privacy practices. Arcade Classics remains responsible for its own obligations as the supplier of products or services and does not use third-party involvement to avoid rights available under applicable law.

14

Complaints and Dispute Resolution

If you have a problem with a product, service, order or repair, please contact us first and provide:

  • your name and contact details;
  • the relevant order, invoice or repair reference;
  • a clear description of the issue; and
  • the outcome you are seeking.

We will review the matter and attempt to resolve it fairly and within a reasonable time.

If a dispute cannot be resolved directly, either party may seek assistance from an appropriate consumer protection body, tribunal, court or dispute-resolution service.

15

Governing Law

These terms are governed by the laws of Victoria, Australia and the applicable laws of the Commonwealth of Australia.

Nothing in this clause prevents a customer from relying on a jurisdiction or forum available to them under applicable consumer protection law.

16

Changes to These Terms

We may update these terms when our products, services, business practices or legal obligations change.

Updated terms will be published on this page with a revised “Last updated” date. Changes will apply prospectively and will not remove rights that have already arisen under an accepted order or agreement.

17

Severability

If any part of these terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to operate where legally possible.
